Where Quiver Travel operates as a registered tourist guide, guiding services are provided in accordance with the applicable South African tourism legislation and tourist guide code of conduct.
South African tourist guiding is a regulated profession under the Tourism Act 3 of 2014.
2. Our Experiences
Quiver currently offers selected experiences including:
-
Peninsula & Penguins tours
-
Stellenbosch Connoisseur Wine tours
-
Cape Town City Gourmet Walking tours
-
Future tours and journeys, including the Garden Route and other destinations
Each tour's booking page will specify the itinerary, duration, inclusions, exclusions, meeting arrangements, price and any specific requirements.
We may make reasonable changes to an itinerary where necessary because of weather, road conditions, conservation requirements, safety considerations, attraction closures, operational requirements or circumstances outside our reasonable control.
Where a significant change is necessary, we will communicate this to you as soon as reasonably possible and, where appropriate, offer an alternative.
3. Booking and Confirmation
A booking is confirmed only once:
-
Quiver Travel has accepted the booking; and
-
the required payment or deposit has been received.
You will receive a booking confirmation containing the relevant details of your experience.
Please check your confirmation carefully and notify us immediately if any information is incorrect.
4. Prices
All prices will be displayed in South African Rand unless otherwise stated.
Prices will clearly indicate whether VAT is included, where applicable.
Where a third-party supplier charges additional fees, entrance fees, meals, tastings, transport or other costs that are not included in the advertised price, these will be disclosed before booking.
Quiver Travel reserves the right to change advertised prices before a booking is confirmed.
Once a booking has been confirmed and paid for, the agreed price will not be increased except where additional services or changes are requested by you.
5. Your Responsibilities
You are responsible for providing accurate information relevant to your booking, including:
-
your name and contact details;
-
the number of people travelling;
-
relevant mobility or accessibility requirements;
-
relevant dietary requirements or allergies;
-
any medical or physical limitations that may reasonably affect participation; and
-
any other information reasonably required to provide the experience safely.
You are responsible for ensuring that you are physically able to participate in the activities included in your chosen experience.
Please follow all reasonable instructions given by your guide and comply with applicable laws, conservation rules, safety requirements and the rules of venues and attractions visited during your tour.
6. Health, Safety and Adventure
Travel involves inherent risks.
Depending on the experience, these may include road travel, walking on uneven surfaces, exposure to sun, heat, cold or wind, wildlife encounters, coastal conditions, swimming or water-related environments, wine and alcohol consumption, and other risks associated with travel and outdoor activities.
We will take reasonable steps to conduct our experiences safely and professionally.
You must inform us before your tour of any condition, limitation or requirement that may materially affect your ability to participate safely.
Certain risks will be specifically brought to your attention where required by law.
Nothing in these Terms & Conditions excludes or limits any liability or consumer right that cannot lawfully be excluded or limited under South African law.
The Consumer Protection Act requires certain risk, assumption-of-risk and limitation provisions to be brought clearly to consumers' attention in plain language.
7. Wine and Alcohol
Some Quiver experiences involve wine tastings or other alcoholic beverages.
Alcohol consumption is optional. You are responsible for consuming alcohol responsibly.
You must not participate in any activity or behave in a manner that creates a safety risk to yourself, the guide, other guests, members of the public or property.
Quiver reserves the right to end participation in a tour where a guest's behaviour becomes unsafe, abusive, disruptive or unlawful.
Guests must comply with applicable South African laws concerning alcohol.
8. Transport
Where Quiver provides or arranges transport, transport may be provided directly by Quiver or by an independent, appropriately licensed third-party operator.
Where a third-party transport provider is used, its own operational terms may also apply.
Guests must comply with reasonable vehicle safety requirements, including wearing seatbelts where fitted.
9. Children
Some tours may not be suitable for young children.
Age restrictions, where applicable, will be stated on the relevant tour page or booking confirmation.
Parents or guardians remain responsible for children participating in a Quiver experience.
10. Personal Belongings
You are responsible for your personal belongings during a tour.
Quiver is not responsible for loss, theft or damage to personal property except to the extent that such liability cannot lawfully be excluded.
We recommend that you carry appropriate travel insurance.
11. Photography and Media
We may occasionally take photographs or video during experiences for Quiver's marketing and social media.
We will not use identifiable images of you for promotional purposes without your consent.
If you do not wish to appear in promotional photography, please let your guide know.
12. Third-Party Suppliers
Some experiences include services provided by independent third parties, including wineries, restaurants, attractions, transport providers, accommodation establishments, parks and other tourism businesses.
We carefully select suppliers where reasonably possible, but third-party services remain subject to their own operational requirements and terms.
Where a third party is responsible for a particular service, Quiver will not be responsible for matters outside our reasonable control, subject always to your rights under applicable South African law.
13. Changes and Cancellations by Quiver
We reserve the right to cancel, postpone or materially alter an experience where this is reasonably necessary because of:
-
severe or unsafe weather;
-
road closures;
-
natural events;
-
government or conservation restrictions;
-
attraction or supplier closures;
-
insufficient operational availability;
-
safety concerns; or
-
circumstances beyond our reasonable control.
Where Quiver cancels a tour and cannot offer a suitable alternative, you will receive a refund in accordance with our Refund Policy.
14. Cancellation by You
Our cancellation and refund arrangements are set out in the Quiver Travel Refund Policy.
Cancellation charges will be reasonable and will take into account factors including the amount of notice given, non-refundable commitments to third parties and the reasonable possibility of reselling the place.
Nothing in our cancellation policy limits rights you may have under applicable consumer protection legislation.
15. Electronic Bookings
Bookings made electronically are subject to the Electronic Communications and Transactions Act 25 of 2002.
Before completing an online booking, you will have an opportunity to review the transaction and correct errors.
ECTA also requires suppliers conducting electronic transactions to provide specified information, including the supplier's identity, price, terms, delivery/service information, refund policy and privacy information.
16. Consumer Rights
Quiver respects the rights afforded to consumers under South African law, including the Consumer Protection Act 68 of 2008.
Nothing in these Terms & Conditions is intended to waive or unlawfully limit a consumer's statutory rights.
Where any provision of these Terms & Conditions conflicts with a mandatory provision of applicable law, the law will prevail.
17. Complaints
We want to resolve problems quickly and fairly.
If you are unhappy with any aspect of your experience, please contact us as soon as reasonably possible so that we have an opportunity to investigate and resolve the matter.
Complaints should be sent to:
Email: lindy@quiver.co.za
Please include your booking reference, date of travel and details of the issue.
18. Disputes
We will make every reasonable effort to resolve disputes directly and amicably.
Nothing in these Terms & Conditions prevents a consumer from exercising any statutory right or referring a matter to a competent regulatory authority or court.
19. Governing Law
These Terms & Conditions are governed by the laws of the Republic of South Africa.
20. Changes to These Terms
Quiver Travel may update these Terms & Conditions from time to time.
The version applicable to your booking will be the version in effect when your booking is confirmed, unless applicable law requires otherwise.

What to include in the T&C document
Generally speaking, T&C often address these types of issues: Who is allowed to use the website; the possible payment methods; a declaration that the website owner may change his or her offering in the future; the types of warranties the website owner gives his or her customers; a reference to issues of intellectual property or copyrights, where relevant; the website owner’s right to suspend or cancel a member’s account; and much, much more.
To learn more about this, check out our article “Creating a Terms and Conditions Policy”.
